A bill to amend chapter 77 of title 5, United States Code, to clarify certain due process rights of Federal employees serving in sensitive positions, and for other purposes.

Grants authority to the Merit Systems Protection Board to review on the merits an appeal by an employee or applicant for employment of a determination of ineligibility for employment in a sensitive position if: (1) the sensitive position does not require a security clearance or access to classified information, and (2) the determination is otherwise appealable.

Read twice and referred to the Committee on Homeland Security and Governmental Affairs.
